PARTICIPANT WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND PHOTO RELEASE

1. ACKNOWLEDGMENT OF RISKS

I understand that participation in a walking tour offered by Black Raven Productions LLC Tours ("Company") involves inherent risks, including but not limited to:

  • Walking on sidewalks, streets, and pathways

  • Uneven pavement, curbs, stairs, and other walking surfaces

  • Low-light or nighttime conditions

  • Weather conditions including rain, heat, cold, wind, and lightning

  • Crossing streets and interacting with vehicular traffic

  • Actions of other participants, pedestrians, motorists, or third parties

  • Physical exertion associated with walking for extended periods

  • Historic properties, districts, and locations not owned or controlled by the Company

I understand that these risks may result in personal injury, illness, property damage, disability, or death.

I voluntarily choose to participate and knowingly assume all risks associated with my participation.

2. HEALTH AND FITNESS REPRESENTATION

I certify that I am physically capable of participating in the tour.

I understand that I am responsible for:

  • Assessing my own physical condition

  • Bringing and administering any medications I may require

  • Monitoring my own health and safety throughout the tour

I agree to discontinue participation and notify the tour guide if I experience any condition that may affect my safety or the safety of others.

3. RELEASE OF LIABILITY

In consideration of being allowed to participate in a Black Raven Productions LLC Tours event, I hereby release, waive, discharge, and covenant not to sue:

  • Black Raven Productions LLC Tours

  • Its owners, officers, directors, employees, guides, contractors, volunteers, affiliates, successors, and assigns

from any and all claims, liabilities, demands, causes of action, damages, losses, costs, expenses, or attorney's fees arising from or related to my participation in the tour, including claims resulting from ordinary negligence, to the fullest extent permitted by law.

This release does not apply to gross negligence, willful misconduct, or any liability that cannot legally be waived under applicable law.

4. INDEMNIFICATION

I agree to indemnify, defend, and hold harmless Black Raven Productions LLC Tours and its representatives from any claims, damages, liabilities, costs, or expenses arising from:

  • My actions or omissions during the tour

  • My violation of laws, regulations, or tour rules

  • Damage I cause to persons or property

5. PARTICIPANT CONDUCT

I agree to:

  • Follow all instructions provided by tour guides

  • Obey all traffic laws and pedestrian signals

  • Remain with the group unless authorized otherwise

  • Conduct myself respectfully toward guides, participants, residents, and businesses

  • Refrain from disruptive, reckless, threatening, or dangerous behavior

The Company reserves the right to remove any participant whose behavior creates a safety risk or disrupts the tour. No refund shall be required for such removal.

6. EMERGENCY MEDICAL CARE

If I become ill or injured during the tour, I authorize Black Raven Productions LLC Tours to seek emergency medical assistance on my behalf if deemed necessary.

I understand and agree that:

  • The Company is not obligated to provide medical care.

  • Any medical treatment, transportation, or related expenses are my sole responsibility.

  • The Company assumes no responsibility for the quality or outcome of any medical care received.

7. PHOTOGRAPHY AND MEDIA RELEASE

I understand that photographs, video recordings, audio recordings, and other media may be captured during tours.

Unless prohibited by law, I grant Black Raven Productions LLC Tours permission to use my image, likeness, voice, and appearance in:

  • Marketing materials

  • Websites

  • Social media platforms

  • Advertising campaigns

  • Promotional publications

without compensation or additional approval.

If I do not wish to appear in photographs or videos, I agree to notify the tour guide before the tour begins.

8. HISTORICAL CONTENT DISCLAIMER

I understand that the tour may include historical accounts, folklore, legends, ghost stories, paranormal claims, local traditions, and entertainment-based storytelling.

Black Raven Productions LLC Tours makes no guarantees regarding the factual accuracy of all stories, legends, or paranormal claims presented during the tour. The tour is intended for educational and entertainment purposes.

9. CANCELLATION AND REFUND POLICY

I acknowledge that I have reviewed and agree to the Company's current cancellation, refund, and rescheduling policies as published on its website and/or booking platform at the time of purchase.

10. MINOR PARTICIPANTS

Participants under the age of 18 must have this waiver signed by a parent or legal guardian.

The parent or guardian agrees to all terms of this waiver on behalf of the minor and accepts responsibility for the minor's conduct and participation.

11. ELECTRONIC SIGNATURE CONSENT

I agree that:

  • My electronic acceptance of this waiver during the booking process shall have the same force and effect as a handwritten signature.

  • Checking an agreement box and completing my reservation constitutes my acknowledgment and acceptance of all terms contained herein.

12. SEVERABILITY

If any provision of this agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13. GOVERNING LAW

This agreement shall be governed by and interpreted under the laws of the State of North Carolina.

Any legal action arising from this agreement shall be brought exclusively in the appropriate courts located within North Carolina.

14. ACKNOWLEDGMENT

I HAVE CAREFULLY READ THIS WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND PHOTO RELEASE.

I UNDERSTAND ITS TERMS, UNDERSTAND THAT I AM GIVING UP CERTAIN LEGAL RIGHTS, AND AGREE TO BE BOUND BY ITS CONDITIONS.
